1. Saying too much

Anything you say can and will be used against you in the court of law. As such, police will remind you that you have the right to remain silent. This is known as one of your Miranda rights.

Saying too much could give police ammunition against you in your case. When asked “have you been drinking tonight,” don’t answer. Don’t lie, but you also don’t have to answer at all. By staying silent until you speak to a lawyer, you can avoid saying something that could be used against you in court.

2. Refusing to take a chemical test

California has implied consent laws, meaning that by driving on the road it is implied that you consent to a blood or breath test after you are arrested. You can refuse to take the test, but refusing comes with its own penalties — some of which are more serious than a DUI charge itself.
